1. Acceptance of terms
By accessing and using the Marai service, you agree to be bound by these Terms of Use. If you do not agree with any of them, do not use the service.
2. Description of the service
Marai is a SaaS appointment management platform that includes: digital calendar, AI WhatsApp bot, automatic reminders, integrated Stripe payments and online booking portal. The service is provided through monthly or annual subscription.
3. Registration and account
To use Marai you need to create an account with truthful information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You must be over 18 years old or have the necessary legal representation to contract on behalf of your business.
4. Free plan
We offer a permanent free plan without requiring a credit card. The Free plan includes 1 professional and up to 50 appointments per month. To access more features, you can choose a paid plan at any time.
5. Subscription and payments
- Prices are published at maraiagenda.com/precios and include VAT.
- The subscription automatically renews at the beginning of each period (monthly or annual).
- Payments are processed securely through Stripe, Inc.
- You can cancel at any time from your dashboard. Access continues until the end of the paid period.
- There are no refunds for partial periods, except as required by law.
6. Acceptable use
You agree not to use Marai for:
- Illegal or fraudulent activities.
- Sending spam or unsolicited communications.
- Collecting data from other users without their consent.
- Attempting to access unauthorized systems or data.
- Reselling or sublicensing the service without express authorization.
7. Intellectual property
The software, algorithms, designs, the Marai brand and all content on this platform are the exclusive property of kaiserdbt and are protected by intellectual property law. Your data (clients, appointments, etc.) is your property — Marai uses it solely to provide the service. The following are expressly prohibited:
- Copying, modifying, merging or distributing any element of the Software without prior written authorization.
- Reverse engineering, decompiling or attempting to extract source code from compiled versions of the Software.
- Using the Software as a basis or reference to build a competing product or service.
- Sharing access to the Software or login credentials with unauthorized third parties.
- Consequences: Violations will result in immediate account suspension, DMCA takedown notice to the hosting provider, and legal action with damages claim.
8. Service availability
We strive to keep Marai available 24/7, but we do not guarantee uninterrupted availability. Planned interruptions will be communicated in advance. Business plans include SLAs with specific guarantees.
9. Limitation of liability
To the extent permitted by law, Marai shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the service. Our maximum liability is limited to the amount paid in the last 12 months.
10. Modifications
We may modify these terms with 30 days' advance notice. If you continue using the service after the changes take effect, you accept the new terms.
11. Applicable law
These terms are governed by Spanish law. For any dispute, the parties submit to the competent courts of Spain, without prejudice to your rights as a consumer under applicable regulations.
